Flexibility Meets Accountability: Proposed Amendments to the Superbonus Deduction in Italy

Amendments submitted by senators from both the majority and the opposition parties propose to extend the distribution of the deduction for the Superbonus into ten or fifteen annual installments. These proposals are part of the Superbonus Decree currently being discussed in the Senate’s Finance Commission.

One proposal suggests that expenses incurred between January 1st and December 31st, 2023 can be divided into ten annual installments, starting from the 2024 tax period, at the taxpayer’s discretion. This amendment emphasizes flexibility for businesses and individuals to plan their investments based on their financial capabilities.

Another amendment, put forward by Senator Massimo Garavaglia from the Northern League, focuses on the role of Municipalities in investigating illicit activities related to the Superbonus and recovering resources. Municipalities would be incentivized to participate in these efforts by receiving a share equal to 50 percent of the sums collected and penalties applied for undue deductions or non-existent tax credits. This amendment aims to increase accountability and transparency in managing public funds.

The proposed amendments also emphasize verification activities such as sharing data with Enea and the Revenue Agency regarding the start of works and qualifications. These controls aim to ensure that interventions carried out correspond to deduction accrual and its proper use, reducing fraudulent behavior and increasing compliance with regulations.

Overall, these proposed amendments seek to balance flexibility for businesses with increased accountability and transparency in managing public funds while ensuring proper use of deductions under the Superbonus program.
