Judge Grants Kaleida Health Participants Right to Obtain Information from Mercer, Nixon Peabody Despite Legal Block

A decision by Magistrate Judge Jeremiah J. McCarthy of the US District Court for the Western District of New York has allowed participants in Kaleida Health’s pension plan to continue their efforts to obtain information from Mercer Investment Consulting and Nixon Peabody LLP through the legal process. The judge ruled that Kaleida’s attempt to block subpoenas on these companies must be addressed in the Southern District of New York, as it is unclear from the record where the subpoena on Nixon Peabody should be handled.

Despite being unsuccessful in its attempt to prevent participants from serving subpoenas on Mercer and Nixon Peabody, Kaleida Health has another opportunity to present its arguments in a different court if they choose to pursue further action to block the subpoenas.
