Navigating the ethical quandaries of integrating AI into law enforcement and court systems: Challenges and opportunities for accountability

The integration of artificial intelligence (AI) in technology, law enforcement, and court systems presents complex questions about accountability and the application of human rights to autonomous intelligences. This raises concerns about how the Constitution interacts with these nonhuman entities. Courts must determine how human rights, duties, and laws should apply to machines within the framework of the Constitution.

One of the significant challenges that arise from using AI in law enforcement is the lack of transparency in decision-making processes. AI tools have been shown to be highly accurate, but their results are often difficult or impossible to explain. For instance, facial recognition AI can identify a suspect with remarkable accuracy, but it cannot provide an explanation for its decision-making process. As a result, there have been instances where these AI systems have resulted in wrongful arrests and increased racial disparities in arrests without any human oversight or scrutiny.

The use of Clearview AI by U.S police has demonstrated this issue’s magnitude. Nearly one million times, this facial recognition tool has been used for law enforcement purposes. However, due to its opacity, law enforcement officers cannot fully understand how these decisions are made or question them on the stand if necessary. Therefore, there is a need for greater transparency and accountability when using AI in law enforcement applications to ensure that human rights are protected and that individuals are not subjected to unjust treatment by these autonomous entities.

In conclusion, integrating AI into technology, law enforcement, and court systems poses several complex questions regarding accountability and human rights violations. There is a need for courts to develop guidelines that address these issues adequately while ensuring that individuals’ fundamental rights are respected and upheld at all times.
