Biden’s Latest Executive Order Gives Dreamers Access to Healthcare under the ACA

President Biden has recently announced a new rule that allows active recipients of DACA, known as “Dreamers,” to enroll in a qualified health plan or basic health plan under the Affordable Care Act (ACA), along with access to financial assistance. This decision follows speculation about potential executive actions on immigration by the Biden administration, such as addressing asylum at the border and providing work permits to certain immigrants living in the country illegally.

While many of these potential actions were controversial, Dreamers, undocumented immigrants who came to the country as minors, have generally received broader public support than other undocumented groups. Immigration has been a prominent campaign issue in this election season, with Biden’s efforts to provide Dreamers with health insurance standing in stark contrast to former President Trump’s attempts to end the program.

Neera Tanden, director of the Domestic Policy Council, emphasized President Biden’s commitment to protecting Dreamers and DACA recipients. The final rule reflects the belief that health care is a right, not a privilege, for all Americans, including DACA recipients. While the rule does not make DACA recipients eligible for Medicaid or parts of the Children’s Health Insurance Program, they can access financial aid programs available to noncitizens who qualify but are ineligible for Medicaid due to their immigration status.

Biden stated that Dreamers are essential members of society, serving as loved ones, nurses, teachers, and small business owners who deserve access to healthcare like everyone else. This policy change underscores the administration’s dedication to supporting these individuals in reaching their full potential while ensuring their health needs are met. The new rule represents an important step towards providing equal access to healthcare for all Americans
