Heart attack compensation: National Insurance Institute’s objections challenged in court over ‘unusual event’

After rejecting the plaintiff’s claim, the National Insurance Institute objected to accepting it citing his pre-existing heart problems and his decision not to seek medical treatment during his travels to the US, Germany, and Israel. However, Judge Ariela Gilzer-Katz of the Tel Aviv Labor Court determined that the number of connecting flights and the duration of the flight constituted an unusual event and ordered a medical expert to examine the causal connection between the heart attack and the flight. The expert confirmed the connection and recognized the heart attack as a work accident.

The medical committee initially rejected the plaintiff’s claim, attributing his medical condition to his previous illness and stating that the surgical scar was not related to the work accident. After filing an appeal, however, they accepted his claims without reduction for his previous illness. He was entitled to a retroactive payment and a future monthly allowance.

The National Insurance Institute responded by emphasizing that work disability allowances were meant to provide financial support for workers who are unable to continue working due to a work-related injury or illness. They expressed their respect for Judge Gilzer-Katz’s ruling but highlighted their concerns about frequent work flights and their belief that there might have been other factors involved in causing the heart attack apart from work. However, they acknowledged that such rulings could occur, and they respected them.

In conclusion, after successful appeals made by him, Mr. Plaintiff received financial compensation for his work-related heart attack despite initial objections from National Insurance Institute who had previously denied accepting his claim due to pre-existing conditions he had suffered during travel abroad without seeking medical treatment despite suffering from heart problems priorly
